Investigating and Litigating Fire Loss Claims – Avoiding Preventable Errors
Property insurers and their retained counsel play a significant role in the fire origin and cause investigation industry with their early involvement in most fire-related losses. This two-hour program will discuss problems that can arise during the investigation and
litigation process related to the retention of fire investigators, expert qualifications,
scene processing, data collection, and analysis, hypothesis development, report writing, deposition testimony, trial testimony, and opinion admissibility with an emphasis on
avoiding preventable errors. This program is intended for insurance claims
professionals and public and private sector fire investigators.

Proving Liability When Litigating Fire Losses
Property insurers vigorously pursue third parties responsible for causing fires. The subrogation recovery process begins with a thorough investigation into the fire’s origin, cause, and spread. This ninety-minute program, premised on an NPFA 921 complaint
investigation, will review how subrogation counsel must factually develop and legally
prove liability and damages, and at the same time, circumvent the defenses that are
traditionally raised. This program is intended for insurance claim professionals and
public and private sector fire investigators.

Discuss basic fire investigation methodology, how using that methodology is critical to obtaining sound conclusions, and why it is important for your expert to comply with the recommendations and standards listed in NFPA 921 and NFPA 1033.

Examine what certifications and background are required of your fire investigator, as well as where the origin and cause investigator's expertise ends, and other subject matter experts' expertise begins.
